1. Agreement to Terms

• Create and manage marketing projects and workspaces

3. Account Registration

To use the Service, you must:

• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account access

Your Content: You retain ownership of data and content you upload. By using the Service, you grant us a license to use, process, and display your content solely to provide the Service.

7. Payment Terms

For paid plans:

• Fees are billed in advance on a subscription basis
• Prices are subject to change with 30 days notice
• You authorize recurring charges to your payment method
• No refunds for partial subscription periods
• Failure to pay may result in service suspension

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOWTIE ANALYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Bowtie Analytics, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Conduct that harms other users or our business
• Extended periods of inactivity
• At our sole discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
